PHOTOGRAPHY AGREEMENT & STANDARD TERMS

1. Services

The Photographer will provide photography services as outlined in Schedule A.

2. Fees & Payment

All fees are outlined in Schedule A.
Unless otherwise agreed, images will be delivered after payment has been received.

3. Copyright & Moral Rights

Copyright in all images remains with the Photographer under the Copyright Act 1968 (Cth). The Photographer retains moral rights in the images.

4. Licence

The Client is granted a licence strictly in accordance with Schedule A. No additional usage is permitted without written approval. Additional licence fees apply as explained in the Licence Fees.

5. Image Alteration and improper use

Images may not be altered, filtered, or manipulated in a way that misrepresents the Photographer’s work without prior consent. Photographer reserves the right to halt the use of Photographs in any publication that could reasonably be deemed offensive or improper, including but not limited to use of the Photographs in virtual backgrounds, political advertisements, propaganda, or pornography works.

6. Third-Party Use

Any third-party requests for image use must be referred directly to the Photographer.

7. Credit

Where practical, credit should be given to the Photographer Davina J. Bambrick in editorial publications where possible and practical, and across all social media platforms.

8. Cancellation & Rescheduling

Cancellations within 1 day of the shoot may incur a fee. Weather or unforeseen circumstances may require rescheduling to a mutually suitable time.

9. Liability

The Photographer is not liable for circumstances beyond reasonable control, including but not limited to weather, access restrictions, or third-party interference.

10. Governing Law

This agreement is governed by the laws of New South Wales, Australia and is supported by the Copyright Act (1968).

11. Interpretation / Aesthetics Disclaimer

The client is aware of Photographer’s personal style and portfolio and waives any right to refuse pament on the basis of dissatisfaction with the end result. No refunds will be provided unless for a material breach of this agreement.

12. Payment

  • A deposit of 50% is require to secure the booking once the date of the photo shoot has been agreed.

  • The final payment must be paid prior to the delivery of the photographs and upon completion of the photo shoot.

12. Agreement

Confirmation of booking, payment of invoice, or use of images constitutes acceptance of this agreement and Schedule A.
